Terms & Conditions
These Terms & Conditions apply to all offers, quotations, agreements and deliveries of Poseidon Food, unless otherwise agreed in writing.
1. Scope
Poseidon Food supplies seafood products exclusively to business clients, including wholesalers, foodservice operators and professional buyers.
2. Offers & Orders
All offers and quotations are non-binding and subject to availability.
Orders are confirmed only upon written acceptance by Poseidon Food.
3. Pricing
All prices are exclusive of VAT, transport, duties and additional costs unless stated otherwise. Prices may be subject to change due to market conditions.
4. Delivery
Delivery terms are agreed per order. Poseidon Food operates under international logistics standards and may use third-party transport providers.
Risk transfers to the buyer upon delivery or handover to the carrier, unless agreed otherwise.
5. Product Quality & Inspection
All products are handled under strict cold-chain logistics and quality standards.
The buyer is responsible for inspecting the goods upon delivery.
Any claims regarding quality, quantity or condition must be reported in writing within 24 hours of delivery.
6. Storage & Handling
After delivery, the buyer is responsible for proper storage and handling of the products in accordance with applicable food safety standards.
7. Liability
Poseidon Food’s liability is limited to the value of the delivered goods.
Poseidon Food shall not be liable for indirect, incidental or consequential damages, including loss of profit or business interruption.
8. Force Majeure
Poseidon Food shall not be held liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to supply chain disruptions, weather conditions or transport delays.
9. Payment
Payment terms are agreed per client or invoice.
In case of late payment, Poseidon Food reserves the right to suspend deliveries or cancel agreements.
10. Governing Law
All agreements are governed by the laws of The Netherlands.
Any disputes shall be submitted to the competent court in The Netherlands.
